Mr. Cardone, what are you doing here? This is all my opinion, but do you fully understand the potential severity of what you are doing by putting out a video celebrating that approximately 900 of the 2,200 investors have opted out of the class action? Because I’m not sure you realize what you may actually be communicating to the remaining investors – and to the people who are watching you decide whether they should opt out. Those investors may be opting out because they have now read the fund’s information and realized that, based on what you have acknowledged under oath, they could potentially lose all of their investment if the plaintiffs ultimately prevail.
If that’s the case, then this video isn’t necessarily the victory you appear to think it is. And here’s the part that concerns me: if even one investor remains in the class action and that investor ultimately prevails, the case doesn’t simply disappear because 900 or even 2,000 people opted out. The remaining plaintiff can still pursue the claims available to them, and any recovery would be governed by the court and the applicable legal process.
Now consider the other side of this. If investors are watching you, relying on what you are telling them, and deciding to opt out based upon that information, what happens if the remaining plaintiff ultimately wins? Could those investors later argue that they relied on your statements in making the decision to opt out and that they were once again provided incomplete or misleading information? I’m not saying that is what will happen. I’m saying your legal team should be asking that question right now – because the people opting out could potentially be giving up far more than their original investment if the plaintiffs ultimately prevail. They could potentially be giving up a much larger recovery based on whatever damages and remedies the plaintiffs may ultimately seek or be awarded under applicable law.
You have already made statements under oath concerning your knowledge, control, and responsibility within your organization. So where is your legal team on this? Mr. Cardone, this is an active legal proceeding. Why are you publicly encouraging or celebrating conduct that could potentially affect the decisions of people who are members of – or may be considering whether to remain in or opt out of – the litigation? And if the plaintiffs ultimately prevail, wouldn’t you rather have your attorneys determine whether statements like this create additional exposure before you put them on the internet?
Bro, seriously – what are you doing here? You may believe you’re demonstrating that the case is falling apart because hundreds of investors have opted out. But you may also be creating a record that could later be examined very differently. At minimum, I would think your attorneys would be telling you: Stop. Think carefully about what you’re saying publicly while this case is still active. I wish you continued success. Just an opinion from a concerned follower. Cheers and blessings.

Rooting for you Grant to not only win this case but to expose the legal industry and to get nee laws enacted against those spineless parasites.
I got a letter last week that I was a part of some class action lawsuit unless I opted out, for some small amount of shares I purchased years ago and never held on to.
I have know idea what it was about and I can’t be bothered doing the due diligence it would take to understand whether I feel wronged enough to be a part of it.
Or even whether it’s a scam (probably easy enough to verify I suppose).
To opt out, I have to fill in a bunch of forms and mail it back to another country.
In the bin it went.
